EB-5 Immigrant Investor Program Overview

EB-5 is the U.S. employment-based immigrant category for foreign investors who are willing to invest capital into the U.S. economy and create jobs for U.S. workers.
Unlike EB-1 or EB-2, EB-5 is not based on education, extraordinary ability, or professional achievements. It is based on investment + job creation.
In simple terms:
 If you have lawful investment capital and are willing to place it into a qualifying U.S. project that creates jobs, EB-5 can lead directly to a green card.
Currently, the minimum investment generally starts at:
 $800,000 (Targeted Employment Area – rural or high unemployment areas)
 $1,050,000 (non-TEA projects)
(Investment thresholds are subject to change based on legislation.)
Here’s why EB-5 is attractive in real cases:
 No education requirement
 No language requirement
 No employer sponsorship
 No need to prove extraordinary ability
 Direct pathway to U.S. permanent residency
 Spouse and unmarried children under 21 included
Unlike employment-based categories, EB-5 does not require you to “qualify professionally.” It is a capital-based immigration route.
However, visa bulletin movement and country caps can affect timelines depending on nationality.
Practical insight: 
 EB-5 is often chosen by business owners, entrepreneurs, and high-net-worth individuals who prefer certainty through capital rather than qualification-based scrutiny.
There are three core requirements: 
 A) Lawful Source of Funds
  This is where many applicants underestimate complexity.
  USCIS requires detailed documentation showing:
   Where the investment funds came from
   How they were earned
   Tax records
   Business records
   Sale agreements (if assets sold)
   Banking trail
  Funds must be legally obtained and traceable.
  In practice, source-of-funds documentation is one of the most critical parts of the case.
 B) Qualifying Investment
  The investment must be placed into:
   A new commercial enterprise
   A USCIS-approved regional center project
   OR 
   A direct EB-5 business structure
  Most investors choose regional center projects because job creation calculations are handled through economic models.
 C) Job Creation 
  The investment must create or preserve at least 10 full-time U.S. jobs.
  For regional center cases, indirect job creation may qualify.
  For direct EB-5, actual payroll employees must be documented.
USCIS evaluates EB-5 in stages:
 Step 1 – I-526E Petition Review
 USCIS checks: 
  Lawful source of funds
  Investment structure
  Job creation model
  Project compliance
 Step 2 – Conditional Green Card
  If approved and visa is available, investor receives a 2-year conditional green card.
 Step 3 – I-829 Petition (Removal of Conditions)
 After approximately two years, USCIS verifies:
  Funds were sustained
  Jobs were created as required
 Approval leads to permanent 10-year green card.
